Description:	The protection of human rights is a necessity in any legal system, as a part of a democratic society. In the evolution of the rights guarantee system, the judicial protection is one of the most important. Therefore, the uniformity into judicial interpretation has become in additional guarantee, considering the value of binding precedent as a source of law. This paper focuses on the relevance of this fact, using a qualitative, analytic and descriptive methodology La tutela de los derechos humanos constituye un imperativo en cualquier ordenamiento jurídico. Es fundamento de la sociedad democrática. Los sistemas de garantías han ido evolucionando y se perfeccionan, constituyendo las de carácter jurisdiccional una de las más importantes. Por tanto, la interpretación que realizan los jueces adquieren una relevancia incontestable y la uniformidad de estos criterios tutelares, una garantía adicional en la protección de los derechos, lo cual reafirma el valor de la jurisprudencia como fuente del Derecho. Sobre la relevancia de este hecho se enfoca el presente artículo, empleando una metodología esencialmente cualitativa, analítica y descriptiva
