Description:	The main objective of this research is to propose negotiation as an alternative solution to contractual breach in times of social distancing since there is currently an overload in the Peruvian judicial system due to the situation caused by COVID-19. In the beginning, the treatment of the Peruvian civil order in the face of the contractual breach is addressed; to later, develop alternative dispute resolution methods, ending in the development of negotiation and its suitability to resolve the present problem, based on the four principles and seven elements of the Harvard negotiation method. La presente investigación tiene como objetivo principal proponer la negociación como solución alternativa frente al incumplimiento contractual en tiempos de distanciamiento social, toda vez que actualmente existe una sobrecarga en el sistema judicial peruano debido a la coyuntura provocada por la COVID-19. En un inicio, se aborda el tratamiento del ordenamiento civil peruano ante el incumplimiento contractual, para después desarrollar los métodos alternativos de resolución de controversias. Se finaliza con el desarrollo de la negociación y su idoneidad para resolver la presente problemática, tomando como base los cuatro principios y los siete elementos del método de negociación de Harvard.
