| Descripción: | The purpose of this work is to investigate and analyze the doctrinal, constitutional and conventional framework that countries such as Spain, Chile, Colombia and Mexico have given to the human right to be forgotten; as well as determining the influence on the adoption or limitation of this right have had the theories, guarantee and criminal law of the enemy, since they are diametrically opposed theories. The comparative method was used. Each country has regulated this human right differently, which has been influenced by both the guarantee theory and the enemy's criminal law theory. El propósito de este trabajo es investigar y analizar el marco doctrinal, constitucional y convencional que países como España, Chile, Colombia y México, han dado al derecho humano al olvido; así como determinar la influencia que en la adopción o limitación de este derecho han tenido las teorías, garantista y del derecho penal del enemigo, puesto que se trata de teorías diametralmente opuestas. Se utilizó el método comparativo. Cada país ha regulado de manera diferente este derecho humano que se ha visto influido tanto por la teoría garantista como por la teoría del derecho penal del enemigo. |
